BuddhaUR — Terms of Service (EULA)

1) What these Terms cover

These Terms govern BuddhaUR: the iPhone and Android apps, the computer version that runs in a web browser, the website buddha-ur.com, and related services (together, the "App"). By using the App you agree to these Terms.

Apple notice: For the iPhone app, these Terms are a custom end-user license agreement ("EULA"). Apple's required minimum terms apply, and Apple is a third-party beneficiary of this EULA. See Section 15, which applies to the iPhone app only.

2) Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority where you live, you must have your parent or guardian's permission. The App is not directed to children under 13. If we learn that an account belongs to a child under 13, we will close it.

3) Accounts, security, and deleting your account

You can create an account with an email and password, Sign in with Apple, or Sign in with Google, wherever each is offered. You are responsible for your password and your device's security. You can delete your account at any time in Settings → Danger zone → Delete Account. That removes your account and its private records from our database. Teachings you shared or published stay online, no longer linked to your account, and we may keep records the law requires (for example, payment records). Our Privacy Policy explains both, and what happens to data our providers already received.

4) License and restrictions

We grant you a limited, non-exclusive, non-transferable license to use the App on devices you own or control; for the iPhone app, also consistent with Apple's Usage Rules. You may not: (a) reverse engineer the App or attempt to extract its source code; (b) bypass or exceed rate limits or other access controls; (c) use bots or scraping; (d) use the App for unlawful, harmful or harassing conduct.

5) Your content and AI features

You keep ownership of what you put in (for example, questions and session notes) and grant us a worldwide, royalty-free license to host, process and display it to run the service, including processing by our AI providers and storing conversation history and "memories" that personalize answers. If you share a teaching by link or publish one to our public collection, you also let us show it publicly as our Privacy Policy describes. You must have the rights to what you submit, and you agree not to submit illegal or infringing material.

6) AI content, for education only

AI responses are generated automatically for educational purposes about Buddhist teachings and meditation and may contain errors or interpretations. The App is not medical or mental-health advice and does not diagnose or treat conditions. If you are in crisis, call local emergency services (in the U.S., 988 or 911).

7) Support payments, cancelling, refunds

BuddhaUR is free for everyone. You can choose to support it with a monthly, yearly or one-time lifetime payment. The price is shown before you pay and may change. Support does not unlock features.

For payments made in the iPhone or Android app: Apple or Google takes the payment. Monthly and yearly plans renew automatically until you cancel in your device's subscription settings. Refunds are handled by Apple or Google under their own rules.

For payments made in the web app: RevenueCat Web Billing takes the payment, using Stripe. Monthly and yearly plans renew automatically until you cancel. To cancel, write to us (Contact Support in Settings, or the email address below); cancelling stops future renewals. We refund any charge if you ask within 14 days of that charge. After 14 days, we don't give partial refunds for the rest of a period.

One-time gifts: When offered, you can give a one-time gift, in an amount you choose from $1 to $1,000, on a Stripe-hosted checkout page reached from our website. Gifts go to Skylark Creations LLC, are not tax-deductible, and do not unlock features. We refund a gift if you ask within 14 days of it.

8) Third-party services

We use outside providers to run the App. Our Privacy Policy names them and describes the data each one receives. We do not sell your data and we do not show ads.

9) Intellectual property

We own the App, its code, design and branding, and our lesson and quiz compilations. The early Buddhist texts are public domain. The English translations we draw on are Bhikkhu Sujato's, published by SuttaCentral, which he has dedicated to the public domain (CC0); we credit him anyway. You may not copy or commercialize our content or databases.

10) Termination

You may stop using the App at any time and delete your account in the app. We may suspend or end access for violations, fraud, legal requirements, or to protect users or our services.

11) Disclaimers

The App is provided "AS IS" without warranties (merchantability, fitness, non-infringement). We do not promise uninterrupted or error-free operation, or accuracy of AI output. Some jurisdictions do not allow certain disclaimers; your statutory rights remain.

12) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, data loss, or loss of profits. Our aggregate liability for all claims relating to the App will not exceed the greater of (a) amounts you paid to Skylark for the App in the 12 months before the claim or (b) USD $10. These limits do not apply to gross negligence, willful misconduct, or injury where liability cannot be limited by law.

13) Indemnity

You will indemnify and hold Skylark (and our affiliates, officers and employees) harmless from claims, damages and costs arising out of your content, your misuse of the App, or your violation of these Terms or the law.

14) Export and sanctions

You represent that you are not located in, and will not export the App to, any country or person prohibited by U.S. law.

15) Apple-specific terms (iPhone app)

Acknowledgement and support: Apple has no obligation to furnish maintenance or support; Skylark is responsible for support.

Warranty: To the extent any warranty exists, it is provided solely by Skylark; Apple disclaims all warranties.

Product claims and IP: Skylark, not Apple, is responsible for product claims and third-party IP claims.

Legal compliance: You must use the App in compliance with U.S. and local law.

Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries and may enforce this EULA.

16) Changes to these Terms

We may update these Terms. We will tell you about material changes in the app or by email. Continuing to use the App means you accept the changes.

17) Governing law and venue

These Terms are governed by the laws of Delaware, USA, without regard to conflicts of law. Courts located in Delaware will have exclusive jurisdiction, except that you may bring claims in small-claims court where permitted.
